6. Terms of use for the use of the DTHG logo for company and institutional members of the German Theatre Technical Society eV
In the download area, DTHG companies and institutional members are offered a special DTHG logo for use
6.1. Permission to use: A contractual usage relationship is established between the DTHG and the user of the DTHG member logo. It has the character of a continuing obligation and is tied to the company or institution's membership in the DTHG, but is not limited in time.
6.2. Authorizations: Authorized users are companies and institutions (i.e. legal entities) that are members according to the statutes §3 of the DTHG and have paid their membership fee. If a member does not pay the membership fee or does not pay it on time, they are in arrears and lose the right to use the DTHG logo. Use is restricted to the member company. Parent, subsidiary or sister companies are not authorized to use it.
6.3. Type of use: The use of the logo is made available to member companies and institutions free of charge. This does not create a right to use the DTHG logo. Member companies and institutions are obliged to use the logo only in conjunction with their own logo or symbol. In particular, the logo may not be used in isolation. Members must ensure that they only use the logo to refer to their membership of the DTHG. They must also make it clear that advertising with the DTHG logo is the result of their own actions and does not represent action on behalf of the DTHG. Any use that is likely to create such a misleading impression is prohibited. In this sense, use is also permitted on letterheads, printed matter and websites. Commercial use on advertising media such as T-shirts, etc. is not permitted. The logo may also only be used in the design offered in the download area of the DTHG website. Changes or additions of any kind are not permitted.
6.4. Sample copies: For each type of use of the logo, a sample copy must be sent to DTHG, Am Hof 28, 50667 Cologne or by email: centrale@dthg.de (pdf file).
6.5. Contractual penalty If a member violates these terms of use of the DTHG logo, DTHG can demand an immediate and complete cessation. The printed materials must be destroyed and not distributed. If the improper use causes damage to DTHG's reputation or impairs its public image, a contractual penalty of €2000,00 (two thousand) is due. Further claims for damages are expressly reserved.
6.6. Termination: In the event that important reasons prevent members from continuing to use the DTHG logo, DTHG has the express right to terminate use with a notice period of 4 weeks. In the event that a member violates the obligations of this user agreement or the statutes of DTHG, DTHG has the right to issue an extraordinary termination with immediate effect.
6.7. Liability: The offer to download the DTHG logo from the download area of the website onto one's own computer may carry the risk of causing damage to the user. DTHG expressly disclaims liability for any damage or impairment of functionality resulting from the download of the logo.
6.8. Place of jurisdiction: The place of jurisdiction is Cologne.
6.9. Severability clause: If a clause in these terms of use is later found to be invalid, this does not mean that it is generally invalid. The contracting parties are then obliged to replace the invalid provision with a provision that corresponds to the spirit and purpose of the terms of use.

7. Liability
7.1 Showtech.me assumes no responsibility towards visitors for the content of the website or for external links, unless Showtech.me is aware of any illegal content and links to external websites with illegal content and does not remove them immediately, either intentionally or through gross negligence. In particular, liability requires that Showtech.me is able and reasonably able to remove the illegal content and links.
7.2 Showtech.me does not guarantee the constant and uninterrupted availability of its online information offering.
7.3 Showtech.me provides this information without any assurance or warranty of any kind, whether express or implied. dthg.de excludes any liability for damages arising directly or indirectly from the use of this website, unless these are based on intent or gross negligence on the part of Showtech.me.
7.4 References and links In the case of direct or indirect references to external websites ("links") that lie outside the area of responsibility of dthg.de, a liability obligation would only come into force if DTHG had knowledge of the content and it would be technically possible and reasonable for it to prevent use in the event of illegal content. Showtech.me hereby expressly declares that at the time the link was set, no illegal content was recognizable on the pages to be linked. dthg.de has no influence whatsoever on the current and future design, content or authorship of the linked pages. Therefore, dthg.de hereby expressly distances itself from all content of all linked pages that were changed after the link was set. This statement applies to all links and references set within its own website as well as to third-party entries via the content management functions. The provider of the page to which reference is made is solely liable for illegal, incorrect or incomplete content and in particular for damages resulting from the use or non-use of such information, not the party who merely refers to the respective publication via links. Links to Showtech.me: You can set links to Showtech.me. The condition for such links is that the DTHG web pages are the sole component of the browser window. The information may not be changed or falsified.
7.5. Marketplace: Liability claims against DTHG, which refer to damages of a material or immaterial nature caused by the use or non-use of the information/advertisements/offers provided or by the use of incorrect and incomplete information, are fundamentally excluded, unless there is evidence of intentional or grossly negligent fault on the part of DTHG.

8. Rejection and termination
dthg.de reserves the right to refuse registrations, to withdraw access authorization from users who violate the General Terms and Conditions and to exclude individual participants at any time without giving reasons.

The law of the Federal Republic of Germany applies exclusively. Should one or more provisions of these terms of use be or become invalid, this shall not affect the validity of the remaining provisions. In such a case, the owner of Showtech.me is obliged to replace the invalid provision with a valid one that actually and legally comes closest to what was originally intended. The same applies in the event of a regulatory gap.

The exclusive place of jurisdiction is Cologne, unless another legally exclusive place of jurisdiction exists.
